If you continue to browse and use this website and/or make an appointment with us, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Policy govern The Bundoora Family Clinic’s relationship with you when you use our website or visit our clinic.
The term ‘The Bundoora Family Clinic’ or ‘us’ or ‘we’ refers to the owner of the website, The term ‘you’ refers to the user or viewer of our website or visitor to our clinic.

2 We reserve the right to update our terms and conditions at our discretion at any time. If we do, the new terms and conditions will be posted on this website. 11 Without limitation to any other terms which are implied into our agreement with you; or by statute in relation to the supply of services which cannot be excluded or limited, we will use all reasonable endeavours to ensure that the services that we provide to you are provided with due care and skill, are fit for the purpose for which they are commonly obtained as is reasonable to expect in the circumstances, will correspond in the nature and quality with the services demonstrated to you.
To the extent permitted by law, unless we have breached these obligations we will not be liable for any death, injury, loss, liability, consequential loss or damage that you may incur as a result of the services provided by us to you.
12 These terms are to be read subject to any legislation which prohibits or restricts the exclusion, restriction or modification of any implied warranties, conditions, guarantees or obligations. If such legislation applies, to the extent possible, we limit our liability in respect of any claim to, at our option:
12.1 in the case of goods:
(a) the replacement of the goods or the supply of equivalent goods; and
12.2 in the case of services:
(a) the supply of the services again; or
(b) the payment of the cost of having the services supplied again.

Products and services

13 We will not provide refunds or exchanges for products or supplements if:
13.1 You change your mind after purchase;
13.2 You find the same or similar products or supplements advertised elsewhere for a lower price;
13.3 It is apparent that you have used or stored the products or supplements contrary to any directions or instructions supplied with the products or supplements.
14 Returns of products will only be accepted in the case where a product is shown to be faulty. If you believe a product is faulty, or if you experience an unexpected reaction to using any product or supplement, you must contact us within three (3) days of discovery of any perceived issue with the product or experience of any unexpected reaction to the product and bring the unused portion of the product or supplement back to the clinic where the product or supplement was purchased.
15 All screening and testing services are provided by a third party and accordingly are not transferable or refundable.
16 All telephone calls to The Bundoora Family Clinic are recorded for training and quality assurance purposes.
17 We offer a 100% money back guarantee on clinic services. If you are unsatisfied with the service you receive in the Bundoora Family Clinic, you must contact us within seven (7) days your first initial consultation in order to claim a refund on the services given. A refund will only be given if it is claimed within the time stipulated in this clause, and applies to services only, and not for products or supplements purchased at the Clinic.
18 Refunds will be provided where required under the Australian Consumer Law but EXEMPTED from any Covid19 related issues/ concerns.

Updating Patient records and your results

It is your responsibility to update your contact details as we do not take any responsibility or liability.
Your results will not be given over the phone. Therefore, it is your responsibility to make follow up appointments with your treating doctor to discuss your results.

Bookings, Rescheduling and Cancellation

Confirmed Bookings

18 In order for us to confirm an appointment in one of our clinics, we will need to take current, valid credit card details from you.
19 Occasionally, unforeseen events arise and we need to cancel your appointment. If your appointment is cancelled due of an unforeseeable event beyond our control, including but not limited to temporary illness of a practitioner, then we may either reschedule the appointment or cancel and refund all monies paid. In the event of a cancellation at short notice, we will endeavour to make alternative arrangements and limit inconvenience to you, but we will not have any liability to you for travel and accommodation costs you may incur as a result of travelling to a city for your appointment.

Rescheduling Appointments and cancellation

20 We have a 24-hour cancellation policy. If you need to reschedule your appointment, you must notify us by telephoning 03- 94677433 no later than 24 hours prior to your appointment start time, or you will be charged the full cost of your consultation using the credit card details supplied when your appointment was made.
21 In order to telephone us if you need to reschedule your appointment, our telephone lines are open 8:30am to 7pm Monday to Friday, and 9am – 1 on Saturday and 9am to 5pm on Sundays (hours may change so please check with the clinic). Should you need to notify us outside of those hours, we also have an after-hours answering service.

Cancellation

22 We must be notified of the cancellation of appointment no later than 24 hours prior to your appointment start time by phone or email (info@myclinic.com.au). Should you fail to attend your appointment or give us 24 hours’ notice, you will be charged the full consultation charge using the credit card details supplied when your appointment was made. This applies to all appointments at The Bundoora Family Clinic.

Failed to Attend

23 If you fail to attend you will be charged $30 for taking another patient’s appointment. This fee must be settled prior to seeing any doctor or doing any medical transactions with our clinic.

Payment

24 Payments for goods and services can be made with cash, Visa or Mastercard at any of our Clinics. Unfortunately, we cannot accept payment by cheque or direct debit.
25 Payments for all services must be made at the time of the appointment.
26 Failure to settle your account within 7 days will result in a warning being issued to settle the outstanding amount. If payment is not received within 10 days, we will be left with no choice but to involve debt collectors or solicitors to recover the debt including their fees and charges. Additionally, your file will be archived, leading to the termination of your care at our clinic.

Bulk Billing

27 Existing patients who have been bulk billed in the last 12 months,
28 Children who are less than 17 years of age,
29 Patients who are above 60 years of age.

Private Billing

30 All patients who do not qualify in the bulk billing criteria listed above and patients who are already privately billed will remain private.

31 This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than with our express written consent.
32 Unauthorised use of this website may give rise to a claim for damages and the Bundoora Family Clinic reserves all of its rights.

35 You must keep us up to date with your contact details by notifying us in writing if your contact details change. In the event that we do not receive written notice from you and your contact details change, notice given by us to
the email or other address we have on our records for you will constitute valid notice to you under these Terms.
36 If we fail to or delay to enforce any of our rights at any time, for any period and for whatever reason, this will not operate as a waiver of those rights, now or in the future.
37 If we fail to notice or act if you breach any of these terms, this shall not mean that we have consented to any breach.
38 If a Court decides that any of these terms are not valid or cannot be enforced, that term will not apply but this will not affect the rest of these terms and the remainder of the terms shall survive.

Recall and Reminder system

Patient’s are required to make a follow up appointment with their doctor to discuss results, please note due to privacy we are unable to provide results over the phone.
If urgent results are received patients will be contacted by our practice nurse to make a follow up appointment so please make sure it is your responsibility to your patient information (contact details, your health summary etc) is up to date with the clinic.
As part of our policy, patients will receive all confirmation of appointments, recalls and health related information via SMS and emails unless stated otherwise. If you are not happy to receive them please call us to notify that you do not want to receive. Once we remove you from receiving SMS, emails and other communications, we cannot take any responsibilities or liabilities related to your health.

Privacy Law

Your Data will be shared within our organisations only. You data is protected according to the Australian Privacy Act.

We will not be liable for any loss, damage, liability, expense, fines, penalties or any other amount directly or indirectly caused by, in connection with, or in any way involving or arising out of any actual or alleged:

(a) any infectious disease, virus, bacterium or other microorganism (whether asymptomatic or not); or

(b) Coronavirus (COVID-19) including any mutation or variation thereof; or

(c) any pandemic or epidemic, as declared as such by the World Health Organisation or any governmental authority.
